The use of this website and all SNOWTRACK applications, services (including payment services), goods, and tools (collectively, the "Services") offered by SNOWTRACK Private Limited or its affiliates (collectively, the "SNOWTRACK Affiliates" are the businesses that SNOWTRACK Private Limited directly or indirectly controls) is governed by this user privacy notice. Regardless of how you use or access our Services—including through mobile devices and apps—this User Privacy Notice is applicable. This User Privacy Notice is also applicable if it is mentioned in a similar way or through a link, such as on partner websites where SNOWTRACK services are not available.
We may change this User Privacy Notice at any time by posting the revised User Privacy Notice on this website and indicating the effective date of the revised User Privacy Notice. You will be notified of any material changes to this User Privacy Notice via Messages in SNOWTRACK and/or by email.
2. Controller
SNOWTRACK is responsible for the collection and processing of your personal data in connection with the provision of the Services depends on how you use our Services.
2.1 Use of the Services (except payment services for sellers)
• One of the following SNOWTRACK Affiliates, depending on the area in which you live, is in charge of gathering and using your personal information in connection with the delivery of our services (apart from payment services for sellers):

2.2 Use of the payment services for sellers
The following SNOWTRACK Affiliates are in charge of collecting and processing your personal data in connection with our payment services for sellers, depending on where you live or where your payments are processed:

Depending on where you live and the SNOWTRACK website where a user completes a transaction with you, one or more of these organisations may process your personal data, as stated in our Payments Terms of Use.

Additionally, please contact us with any concerns or questions you may have about our data protection policies (see section 6.1, Data transfers to SNOWTRACK Affiliates), or this User Privacy Notice. This is true whether or not we have designated a data protection officer.
4. What personal data we collect and process
When you use our services, register for a new SNOWTRACK account, submit information to us via a web form, add or amend information in your SNOWTRACK account, take part in online community conversations, or engage with us in any other way, we gather your personal data. Additionally, we obtain personal information from other sources (including data providers, credit agencies or bureaus, and SNOWTRACK Affiliates).
In total, we collect the following personal data:
4.1 Personal data you provide when using our Services or creating an SNOWTRACK account
• Personally identifiable information that you enter when creating your SNOWTRACK account, such as your name, address, phone number, email address, username, or shop licence number from the Rural District Council.
• Any additional identification information that you provide when using our payment and other services as a seller, such as a bank account number, date of birth, government-issued identification, identification documents and information contained on IDs, identification documents, and information contained on IDs, selfie photos, if you use our services as a seller.
• Purchase or sales data that you supply during a transaction.
• Financial data, such as account and credit card numbers, transaction information, and mode of payment.
• In certain situations: gender, age, nationality, place of birth, work status, family status, hobbies, and preferences.
• Information that can be used to identify you, like your name and email address, as well as any further information you include with your report when you submit it to SNOWTRACK.
• You can give us more information by filling out a web form, updating or adding details to your SNOWTRACK account, taking part in member chats, community discussions, surveys, questions, dispute resolution, and customer service calls that are recorded with your permission. You can also contact us for any other reason related to our services.
• Additional information that we must gather and handle in order to comply with any legal requirements, or that we require in order to verify the information we gather or to authenticate you.
4.2 Personal data we collect automatically when you use our Services or create a SNOWTRACK account
• Information that is created in connection with one of your transactions (such as sales, purchases, or fees) or that is connected to your SNOWTRACK account as a consequence of a transaction in which you are involved. Examples of this information include transaction amounts, transaction times and locations, and payment or payout methods.
• Information derived from other activities you take on our Services and associated with your SNOWTRACK account (such as adding products to your shopping cart, adding them to your watch list, saving sellers, searches, or interests, following users, or attempting to use third-party partners' services for payments or other purposes.
• Information about your conversations with us, your advertising preferences, and any other interactions you have with our services.
• Location information, such as your IP address and, with your consent, the exact location information of your mobile device. Please be aware that the settings menu on the majority of mobile devices allows you to choose how precise location services are used by all applications.
• Some metadata that captures your camera's settings is attached to photos of goods you post for sale.
• Computer and network data, including usage statistics for our services, data traffic to and from websites, referral URLs, information about adverts, your IP address, access times, including pages viewed within our services, language preferences, and weblog data.
4.3 Personal data we collect in connection with the use of cookies and similar technologies
For the purpose of gathering data related to our Services, we utilise cookies and related technologies. We get this information from the devices (mobile and otherwise) that you use to access our services. The following usage- and device-related data is part of the collected data:
• Information about the pages you view, the time it takes to access them, how often you visit them, what links you click, and other activities you take when using our services, as well as information that appears in emails and advertisements.
• Information on your online activities and interactions with our advertising partners, such as the types of ads you saw, when, where, and how often they appeared, as well as any actions you made, including clicking on an advertisement or making a purchase.
• The user category or segment that you, the user, belong to, e.g., female, aged 20–49, interested in trainers.
• The IP address that your device uses to connect to our services.
• Location information, such as your IP address and, with your consent, the exact location information of your mobile device. Note that most mobile devices have a settings menu where you may control or prevent any applications from using exact location services.
4.4 Personal data from other sources
We also collect personal data about you from other sources and from third parties to the extent permitted by applicable law. In particular, this includes the following data:
• Information from open sources.
• Information on your online activities and interactions with our advertising partners, such as the types of ads you saw, when, where, and how often they appeared, as well as any actions you made, including clicking on an advertisement or making a purchase.
• Data from data providers (such as demographic, interest-based, and online advertising-related data, as well as “Know Your Customer”/identity verification data).
• With reference to our payment services for sellers: information from governmental or other sources on the seller’s prior convictions, to the degree allowed by applicable law
We integrate or merge the personal information we get from you with information we get from these other sources. When third parties give us access to personal information about you, we take precautions to make sure that they have the legal right to do so. We also get access to your personal information through SNOWTRACK Affiliates.
4.5 Social network data you share with us
• You can create a SNOWTRACK account or link your SNOWTRACK account to single sign-on services that you already have an account with by using providers of single sign-on services (like Facebook). When you authorise the connection with the single sign-on service, you can choose which personal information we can access.
• We permit you to connect your SNOWTRACK account to a social network or to exchange personal information with social networks (like Facebook). Certain personal information that these social networks have retained about you, such as content you have read or appreciated, details about the adverts you have seen or clicked on, etc., may be automatically provided to us by them. You can choose which personal information we have access to by going through each social network's privacy settings. Plug-ins and other technologies from different social networks might also be used. You freely connect to a social network when you click on a link shown by a plug-in for that social network.
5. Purposes and legal basis for data processing and categories of recipients
We use a number of different legal justifications to treat your personal data for a variety of reasons. For instance, we use your personal information to deliver and enhance our services, give you a tailored online experience, get in touch with you regarding your SNOWTRACK account and our offerings, offer customer support, send you tailored advertisements and marketing messages, and identify, stop, mitigate, and look into fraudulent or illegal activity. 5.1 We process your personal data in order to fulfill our contract with you and to provide you with our Services. This includes the following purposes:
• Processing of data relating to you or your company for the purpose of entering into a contract with you and executing it.
• Providing and enhancing features like payment processing, ratings, authentication services, and SNOWTRACK account management; providing other services you may use (as described in connection with such services); and guaranteeing the functionality of our Services. This includes enabling and carrying out transactions with other users (including the transmission of your personal data to other users where necessary to perform the transaction, including in cases of terminated, failed, or subsequent In accordance with the communication settings set up in your SNOWTRACK account, we shall notify you about transactions and service usage in connection with the provision of our services.
• Providing general customer support, such as resolving issues with your SNOWTRACK account, arbitrating disputes, offering additional services within the purview of customer service, and enforcing fee claims; • Providing our payment services in compliance with the Payments Terms of Use. We may get in touch with you for these reasons using mail, phone calls, emails, SMS, push notifications on your mobile device, and SNOWTRACK notifications. In compliance with our User Agreement and Payments Terms of employ, and to the extent allowed by applicable legislation, we may employ automatically dialled calls with tape announcements or automatically generated text messages if we contact you by phone in order to ensure efficiency.
• Processing of general location data (such as IP address or postal code) in order to provide you with location-based services (such as radius search and other content that is personalized on the basis of your general location data).
• Enforcement of our User Agreement, Payments Terms of Use, this User Privacy Notice and other rules and policies.
• Publication and promotion of your listings and associated content on SNOWTRACK Affiliates' websites, as well as in their applications, services, and tools, or on websites, applications, services, and tools operated by cooperative third parties. We only disclose the content of your listings and any associated personal information to third parties under the terms of a contract that restricts the third party's use of the information to what is required to carry out its responsibilities under the terms of our agreement. Contractually, third-party providers must take the necessary precautions to secure this data. It is strictly forbidden for third-party suppliers to give other third parties access to personal information found in your ads.
Where necessary, we transmit your personal data to processors and the following recipients for one or several of the purposes described above:
• Other SNOWTRACK users
• SNOWTRACK Affiliates
• External service providers, authentication partners, physical storage service partners
• Government agencies or public authorities (including customs and tax authorities)
• Payment service providers
• External operators of websites, applications, services and tools
5.2 We process your personal data in order to comply with legal obligations to which we are subject. This includes the following purposes:
• Taking part in enquiries and actions (including legal actions) carried out by government organisations or public authorities, specifically with the aim of identifying, looking into, and punishing criminal activity.
• The prevention, detection, and mitigation of illicit actions (such as money laundering, fraud, child abuse, and law violations), as well as compliance with reporting obligations.
• Providing information to third parties upon request in line with their statutory rights to information about us (for instance, in the event of product piracy, intellectual property infringement, or other unlawful action).
• Adhering to data access obligations under payment services legislation as a payment service provider;
• Respecting consumer protection, anti-fraud, online platform, and tax legislation regarding information collection, verification, disclosure, and reporting.
• Making certain that our services are secure

5.3 We process your personal data in order to protect your vital interests or the vital interests of another natural person. This includes the following purposes:
• Prevention, detection, mitigation and investigation of unlawful activities that may result in impairment of your vital interests or the vital interests of another natural person, unless there is a statutory obligation to this effect.
5.4 When it's required, we process your personal information to further our or a third party's legitimate interests; however, we don't do so if your interests or your fundamental rights and freedoms prevail. We have implemented suitable control systems to balance your rights with our reasonable interests. We process your data for the following reasons based on this:
• Participating in investigations and proceedings (including judicial proceedings) carried out by courts, law enforcement agencies, government agencies or public authorities, intergovernmental or supranational bodies, with a particular focus on identifying, looking into, and prosecuting illegal acts, barring a statutory requirement to the contrary. In this case, it is reasonable to assume that disclosing the data is required to report a suspicion of an illegal act or to prevent impending harm. In these situations, we will only provide information about you that we deem essential and as allowed by relevant legislation, including your name, city, zip code, phone number, email address, IP address, (past) usernames, fraud complaints, and listing history.
• Protection of third parties' legitimate interests in relation to civil law disputes, including the investigation of such disputes, provided that we may reasonably assume that disclosing the data to such third parties is necessary to prevent impending disadvantages, absent a statutory obligation to the contrary. In these situations, we will only provide the third party with information that we deem necessary, as allowed by applicable laws. This information may include the seller's name, address, city, zip code, country, phone number, email address, and company name. We will also bind the third party to a global non-disclosure agreement, requiring them to treat the data as confidential.
• Preventing, identifying, mitigating, and investigating fraudulent activities, financial crimes and harms, breaching international laws, security incidents, and other illegal or prohibited activities. This includes evaluating related risks and putting appropriate measures in place (like using captchas, port enumeration technology to identify user sessions using remote desktop tools, metadata, or the phone number stored in your SNOWTRACK account for risk assessments and two-factor authentication), unless there is a legal requirement to do otherwise.
• Confirming the authenticity and lack of malicious intent of reports (including anonymous complaints) submitted to SNOWTRACK.
• Tracking and enhancing the security of our services, barring any legal requirements to the contrary.
• Conducting identity, creditworthiness, and other financial standing checks; assessing applications; and comparing data to ensure correctness and validity.
• To stop fraudulent or suspicious conduct, as well as violations of our User Agreement or other rules and policies, messages sent through our messaging tools—including chat messages and emails sent to SNOWTRACK alias email addresses—are automatically filtered and, when needed, manually reviewed.
• Providing consumers with services that facilitate or ease transaction processing (e.g. administration of various delivery addresses)
• Analysis and enhancement of the services provided by SNOWTRACK Affiliates, such as by looking over site usage statistics or user reports regarding blocked or crashed sites, in order to find and fix issues and give you a better user experience, even during product development.
• Examination of phone calls that we, with your permission, recorded with our customer support representatives.
• Mail-based advertisements based on your SNOWTRACK account's communication preferences.
• Communications with you by phone or electronic mail (such as text or email) to offer you coupons, discounts, and special offers; to conduct surveys and opinion polls; and, to the extent allowed by applicable law, without your consent, to inform you about our Services (in accordance with your communication preferences in your SNOWTRACK account). You can also unsubscribe by clicking the link in the email's footer if you would like to stop receiving marketing communications from us. Technical issues could cause the implementation to take several days.
• Personalisation of page content to show products and services that you might find appealing in response to your activities.
• Assessment of our email marketing efforts' effectiveness and quality (e.g., by looking at open and click rates).
• To the extent allowed by applicable law, providing or enabling the provision of partner and bonus programs as well as other co-branded marketing initiatives (such as seller financing offers, product warranties, or co-branded credit cards in association with a third-party lender, partner, or credit card issuer).
• Sharing resources and services (including customer support, transaction processing, and service registration) with SNOWTRACK Affiliates or collaborating payment service providers.
• Comencement, planning, and implementation of a business purchase, such as in the case of a merger or takeover by another business. In the event that such an event takes place, we shall demand that the combined company abide by this User Privacy Notice with regard to your personal information. If your personal information is processed for any reason not included in this User Privacy Notice, you will be notified before your information is used for that new purpose.
• Filing lawsuits or defending against them, especially if two SNOWTRACK users file lawsuits against one another.enabling SNOWTRACK Affiliates to fulfil their legal commitments, such as gathering, confirming, disclosing, and filing information as required by consumer protection, anti-fraud, internet platform, and tax laws.
• To fulfil an upcoming legal requirement.

• SNOWTRACK Affiliates
• External service providers
• Other SNOWTRACK users
• Law enforcement agencies, courts, government agencies or public authorities, intergovernmental or supranational bodies

• Payment service providers
• Third-party partners in furtherance of offering commercial financing opportunities
• Credit agencies or bureaus, data verification services, risk assessment vendors and collections agencies (e.g. information about payment delays, payment defaults, or other irregularities that may be relevant to your credit report, or that we use to confirm your identity, model risk, establish credit limits, or collect unpaid debts)
• Other companies in the context of a company acquisition
5.5 With your consent, we process your personal data for the following purposes:
• Advertising and content personalization, measurement and analytics, on and off our sites
• Communications with you by phone or electronic mail (such as text messages or emails), including those from SNOWTRACK Affiliates or other third parties, offering you coupons, deals, and exclusive offers, unless such communications are allowed without your permission under the relevant laws. We might hire outside companies to handle our marketing correspondence.
• Utilising precise location data processing to deliver location-based services. Please be aware that the settings menu on the majority of mobile devices lets you choose how precisely location services are used by all apps.
• Saving your account numbers and credit card details for use in future transactions.
• The availability of a single sign-on feature that lets you use your SNOWTRACK login information to register for or log into third-party services.
• For sellers, the processing of your biometric information in relation to Know Your Customer and related regulatory obligations, as well as to identify you, further prevent fraud, and lower other risks on our platform.
• The use of your personal data in accordance with your consent, which we or third parties may use to provide you with access to or enable the use of particular services.
Where necessary, we transmit your personal data to processors and the following recipients for one or several of the purposes described above:
• SNOWTRACK Affiliates
• External service providers
• Third parties using our single sign-on service (as authorized by you in each single case)
• Other third parties with whom we partner to offer you specific services (as described at the collection of the respective user consent)
• Third-party advertising partners such as Google, Meta, Microsoft, Pinterest, and TikTok .
5.6 Data Sharing between SNOWTRACK Affiliates
We also get access to personal information about you from SNOWTRACK Affiliates, as mentioned above under "Personal data from other sources". By analysing your use of SNOWTRACK Affiliates' services, particularly through the matching of certain data (e.g. cookie IDs), this enables us, among other things, to improve our products, services, content, and advertising. We can also provide you information about products and services that we think you might find interesting, with your consent as required by law. Moreover, this facilitates enhanced prevention, detection, mitigation, and investigation of fraudulent activities, security events, and other illicit or forbidden actions, along with the evaluation of associated risks. For the aforementioned uses, we shall also provide SNOWTRACK Affiliates access to your personal information. SNOWTRACK Affiliates will adhere to procedures that are at least as stringent as those outlined in this User Privacy Notice to the extent that they have access to your personal data.
5.7 Additional information regarding our payment services for sellers
This includes in particular the following third parties and business partners:
• Other payment service providers, including financial institutions
• Companies offering financial products, analyses and scoring (e.g. credit agencies or bureaus)
• Authorities, agencies and other governmental bodies (e.g. to combat fraud)
• Auditors and other professional advisors
5.8 Automated decision-making
We make use of technology that are categorised as profiling or automated decision making. Unless such a decision is essential for entering into or performing a contract with you, we have your consent, or we are required by applicable law to use such technology, we will not make any automated choices about you that might materially affect you.
6.0 Data transfers to SNOWTRACK Affiliates
In accordance with our global data protection principles, which are legally binding internal data protection regulations, or in accordance with other suitable safeguards, personal data is transferred between SNOWTRACK Affiliates (e.g., to facilitate cross-border transactions and for other legally permitted purposes). SNOWTRACK Affiliates agree to secure your personal information and to abide by data protection laws through our Binding Company law Rules
7. Storage duration and erasure
We and our service providers will save your personal information in compliance with relevant data protection legislation for the duration required to fulfil the processing activities specified in this User Privacy Notice. Unless we are legally required or permitted to keep your personal data longer (for example, for legal compliance, tax, accounting, or auditing purposes, or to detect and prevent fraudulent or illegal activity on SNOWTRACK), we will then delete your personal data in accordance with our data retention and deletion policy or take steps to properly render the data anonymous. Retention periods, such as those for contracts, notifications, and business communications, often range from six to ten years. Rather than erasing your data, we restrict its processing to the extent that is needed by law (for example, by limiting access to it). This is especially true in situations where we might still require the data to carry out the terms of the contract, to make or defend against legal claims, or in situations where the law otherwise mandates or permits such retention. In these situations, the length of the processing restriction is determined by the corresponding statutory retention or limitation periods. After the applicable limitation or retention periods have passed, the data will be removed.
• Necessity for the provision of our Services
This covers tasks including carrying out the terms of our User Agreement with you, keeping our systems safe, enhancing the functionality of our products, and keeping accurate financial and business records. This broad concept serves as the foundation for the majority of our retention durations.
• Consent-based processing of personal data
We keep personal data for as long as is required to handle it in accordance with your consent if we process it based on consent, including consent for extended storage.
• Statutory, contractual or other similar obligations
Corresponding storage obligations may arise, for example, from laws or official orders. It may also be necessary to store personal data with regard to pending or future legal disputes. Personal data contained in contracts, notifications and business letters may be subject to statutory storage obligations depending on national law.
8. Rights as a data subject
As a data subject, you have the right to access, rectification, deletion, restriction of processing, and data portability with regard to your personal data, subject to any limitations that may be imposed by national law. Additionally, you have the option to object to our processing of your personal data based on our legitimate interests and to withdraw your permission. Another option is to file a complaint with a supervisory body.
Your rights in detail:
• Where we rely on consent you can withdraw your consent to the processing of your personal data by us at any time. As a result, we may no longer process your personal data based on this consent in the future. The withdrawal of consent has no effect on the lawfulness of processing based on consent before its withdrawal.
• You are entitled to access the personal information that we process about you. You can specifically ask for information about the processing's goals, the categories of personal data involved, the recipients to whom the data have been or will be disclosed, and, if applicable, the anticipated length of time the data will be stored or the standards used to calculate that length of time. • You have the right to lodge a complaint with a supervisory authority
• You have the right to object to the processing of your personal data if it is done so on the basis of our legitimate interests for reasons specific to your situation. This holds true for profiling as well. You have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling to the extent that it is connected to such direct marketing, if your personal data is processed by us for such purposes.
Exercising your rights and managing your settings
You can use the official email address to get in touch with the controller, who is in charge of processing your personal data, or the SNOWTRACK at any time. The aforementioned data subjects' rights (such as the right of access or erasure) can usually be exercised without cost. In cases where requests are blatantly excessive or baseless, especially due to their recurrent nature, we reserve the right to refuse to execute the application or to impose an appropriate fee (up to our actual expenses) in compliance with the relevant statutory laws.

You can modify your options at any moment for SNOWTRACK messages (including marketing communications) by logging into your account and going to "Communication Preferences" in My SNOWTRACK. You may also unsubscribe by clicking the link in the email's bottom if you would prefer not to receive any more marketing emails from us. Technical issues could cause the implementation to take several days.
9. Data security
We utilise organisational and technical security measures to protect your personal data in order to reduce the risk of data loss, misuse, unauthorised access, disclosure, and alteration. In order to achieve this, we employ logical access controls for data and system access, physical access limits for our data centres, and network security services and data encryption, among other strategies.

What happens when you share your personal data on our sites or applications?
